Water Law

J. Craig Smith and David B. Hartvigsen of Smith Hartvigsen are two of Utah 's most respected water law attorneys. They and other attorneys at Smith Hartvigsen are regular speakers on water law and related topics at seminars and conferences and occasionally appear at meetings around the state and on radio because of their water law practice.

In addition to being recognized in the legal community for its water law attorneys, Smith Hartvigsen has extensive administrative, trial, and appeals experience on many water-related issues, including water rights, water quality, mining and sewage treatment issues.  Members of the firm have collaborated with many other professionals and experts in all areas of water law, including water rights valuation, engineering, well drilling, system design and construction, water biology, hydrogeology, and title insurance. The ability to call upon and utilize these established relationships allows Smith Hartvigsen to provide its clients with professional service.

Smith Hartvigsen also provides in-house capability for evaluating approved uses of existing water rights and for assisting its clients in obtaining approvals for change applications.  We can also provide other assistance to those water users challenged by urbanization along the Wasatch Front who are experiencing substantial growth and change to historic water uses. For example, we represent all types of water users, including water companies and LLCs, for-profits and non-profits, and also municipalities and special districts.  We also can assist you with the creation of articles, by-laws and rules governing your culinary, secondary, irrigation or municipal water system.
